Terms of Service

1. Agreement to Terms

By accessing or using RootedField ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Use of Google OAuth

RootedField uses Google OAuth for authentication. By signing in with Google, you authorize us to access your basic profile information (name, email address, and profile picture) as provided by Google. We use this information solely for account creation, authentication, and communication purposes. Your use of Google OAuth is also subject to Google's Terms of Service and Privacy Policy.

3. Eligibility and Account Registration

You must be at least 18 years of age to use the Service. By creating an account, you represent and warrant that you meet this age requirement and that all information you provide is accurate and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscription Plans and Billing

RootedField offers both free and paid subscription plans. Paid plans are billed on a recurring basis (monthly or annually) as selected by you. By subscribing to a paid plan, you authorize us to charge your payment method for the applicable fees. All fees are non-refundable except as required by law. We reserve the right to change our pricing at any time, with notice provided to existing subscribers before the change takes effect. Your continued use of the Service after a price change constitutes acceptance of the new pricing.

6. User Content and Data Ownership

You retain ownership of all data and content you upload to the Service ("User Content"), including but not limited to tree records, photos, notes, and activity logs. By using the Service, you grant us a limited, non-exclusive license to store, process, and display your User Content solely for the purpose of providing the Service to you. We do not claim ownership of your User Content, and we will not share it with third parties except as necessary to provide the Service or as required by law.

7. Intellectual Property Rights

The Service, including its software, design, text, graphics, logos, and other content (excluding User Content), is owned by RootedField and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or reverse engineer any part of the Service without our prior written consent.

8. Disclaimers and Limitations of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

To the fullest extent permitted by law, RootedField shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use or inability to use the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless RootedField, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.

10. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Service will immediately cease. You may also terminate your account at any time by contacting us at support@rootedfield.com. Upon termination, we will delete your User Content in accordance with our data retention policies, unless we are required to retain it by law.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which RootedField is headquartered, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law. You waive any right to participate in a class action lawsuit or class-wide arbitration.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated Terms on this page and update the "Last Updated" date at the top. We will also notify you of material changes via email or through the Service. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms.

13. General Provisions

These Terms constitute the entire agreement between you and RootedField regarding the Service and supersede any prior agreements. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. You may not assign or transfer these Terms without our prior written consent, but we may assign them without restriction.
